FundedSeat Terms & Conditions

Effective Date: April 1, 2025

These Terms & Conditions (“Terms”) govern your use of the FundedSeat website, platform, and services provided by FT Imperium Ltd OOD (“FundedSeat,” “Company,” “we,” “us,” or “our”). By purchasing, accessing, or using our services, you agree to these Terms. If you do not agree, you must not use our services.

II. User Eligibility

• Age Requirement: Users must be at least 18 years old.
• Compliance: Users are responsible for complying with all local laws, including tax reporting.
• Account Integrity: Users may not share login credentials or create multiple accounts. Doing so may result in termination and forfeiture of fees and profits.
• Prohibited Affiliations: Users cannot be owners, employees, or related parties of another funded company.

III. Services & Subscriptions

• FundedSeat provides evaluation accounts, simulated trading accounts, and educational services.
• Subscriptions renew automatically every 30 days unless canceled prior to renewal.
• Users are solely responsible for managing cancellations through their account dashboard.

IV. Fees, Refunds & Chargebacks

• No Refunds: All fees (evaluation fees, subscriptions, resets, add-ons) are strictly non-refundable once access is granted, regardless of:
  • account failure,
  • disqualification due to rule violations,
  • lack of use,
  • technical issues on the user’s side, or
  • unmet expectations.
• Service Fulfillment: Services are considered delivered in full once login credentials or platform access are provided.
• Chargeback Waiver: By purchasing our services, you agree not to initiate any chargeback with your bank, card issuer, or payment provider. Filing a chargeback after receiving services is a material breach of contract. Chargebacks will be treated as fraudulent, and your account will be permanently terminated. The Company reserves the right to pursue collection of disputed amounts, including legal, administrative, and attorney fees.
• Disputes: If you believe there has been a billing error, you must contact support@fundedseat.com within 7 days of purchase before taking any external action.

V. User Conduct & Restrictions

• Users must trade ethically and comply with FundedSeat’s Code of Conduct.
• Prohibited behaviors include:
  • Exploiting platform errors or latency,
  • Using prohibited strategies (e.g., news trading, sudden enrichment strategies, arbitrage),
  • Trading non-permitted instruments (only CME, COMEX, NYMEX, CBOT products allowed),
  • Abusive or disrespectful behavior toward staff or other traders.
• Violations will result in account termination without refund.

VI. Risk Notice

Trading involves significant risk of loss and is not suitable for all individuals. You may lose more than your initial purchase amount. Only risk capital should be used. Past performance is not indicative of future results.
Hypothetical results may not reflect actual performance due to limitations such as liquidity, fees, and hindsight.

VII. Intellectual Property & Data

• All FundedSeat materials, content, software, and data remain the Company’s property.
• Unauthorized reproduction, resale, or redistribution is strictly prohibited.
• Users must ensure all submitted information is accurate and up-to-date.

VIII. Termination

• The Company may suspend or terminate your account for:
  • violations of these Terms,
  • chargebacks,
  • fraudulent or abusive activity,
  • use of multiple accounts.
• Termination consequences:
  • Immediate loss of access to all accounts,
  • Forfeiture of all unpaid profits,
  • No refunds for fees already paid.

IX. Limitation of Liability

To the fullest extent permitted by law:
The Company is not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.
Total liability is limited to the total fees paid by the user in the past 3 months.

X. Indemnification

You agree to indemnify, defend, and hold harmless FundedSeat, its affiliates, employees, and contractors from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

XI. Dispute Resolution

• Negotiation First: Users must attempt to resolve disputes directly with FundedSeat before pursuing external remedies.
• Arbitration: Unresolved disputes will be settled by binding arbitration in Sofia, Bulgaria (or Delaware, USA, if entity is shifted).
• Class Action Waiver: You waive any right to participate in a class action against FundedSeat.

XII. Force Majeure

The Company is not liable for delays or failures caused by events outside its control, including but not limited to natural disasters, internet outages, exchange interruptions, or government actions.

XIII. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our services after updates constitutes acceptance of the new Terms.
